1. Introduction

Welcome to Solana Momentum Markets ("SMM," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Solana Momentum Markets platform, including any associated websites, mobile applications, and services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Eligibility

You must be at least 18 years old to access or use the Platform. By accessing or using the Platform, you represent and warrant that you are at least 18 years old.

The Platform is not available to residents of jurisdictions where participation in cryptocurrency trading or blockchain-based platforms is prohibited by law. It is your responsibility to ensure that your use of the Platform complies with all applicable laws in your jurisdiction.

3. User Accounts

To access certain features of the Platform, you may need to connect a Solana-compatible wallet. You are responsible for maintaining the security of your wallet and any credentials associated with it.

You are solely responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Platform Services

The Platform allows users to acquire tokens representing teams or participants in sporting events. These tokens are locked for selling until the event concludes, at which point the winning team's token holders receive rewards and the losing team's token value goes to zero.

We do not guarantee the availability, accuracy, completeness, or timeliness of the Platform or any content on it. We reserve the right to modify, suspend, or discontinue the Platform or any part of it at any time without notice.

5. User Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable laws
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform
• Use any robot, spider, crawler, scraper, or other automated means to access the Platform
• Bypass measures we may use to prevent or restrict access to the Platform
• Engage in market manipulation or fraudulent activities
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

6. Fees and Payments

The Platform charges a 5% fee on all token acquisitions. This fee is distributed as follows:

• 3% to the rewards pool
• 1% to the liquidity pool
• 0.5% to the development fund
• 0.5% to marketing and community engagement

All transactions on the Platform are conducted in cryptocurrency. We are not responsible for any losses due to cryptocurrency price fluctuations or blockchain network issues.

7. Intellectual Property

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of SMM or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform without our prior written consent.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Platform will be secure or available at any particular time or location. We are not responsible for any losses due to system failures, network issues, or other technical problems.

Cryptocurrency trading involves significant risk. You should carefully consider your financial situation and risk tolerance before participating in any activities on the Platform. Past performance is not indicative of future results.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SMM, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

Our total liability to you for all claims arising from or related to the Platform shall not exceed the amount you have paid to us in the last six months, or $100, whichever is greater.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration conducted in the Cayman Islands in accordance with the rules of the International Chamber of Commerce.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through the Platform or by other means. Your continued use of the Platform after such notice constitutes your acceptance of the modified Terms.
